ATTENTION:
Our private e-mail facilities are not your advertising medium.
People who use them as such abuse our resources and waste our time,
which are extremely valuable. We have entered your e-mail address
and company name in our corporate blacklist database. We will not
do business with you now, nor will we consider other requests from
you in the future.
Remove this e-mail address from your junk mail list immediately
and do not contact us EVER again in the future.
WHAT LAWS YOU ARE VIOLATING:
WHAT LAWS YOU ARE VIOLATING: Your message is in violation of: the
Federal CAN-SPAM ACT of 2003, (The LAW was signed by the President
on December 16, 2003, and takes effect on January 1, 2004.),
the Federal Telephone Consumer Protection Act of 1991, and
Collateral Code of Federal Regulations (47 CFR 64.1200).
The TCPA allows a private right of action against
the sender of unsolicited advertising. The recipient can sue
for $500, or actual damages (whichever is greater).
Although many spam generators like yourself will claim that their
activities are protected under the first amendment of the United
States constitution, assuming you can read – have any sort of
concience, we have included the 1st amendment to the United States
constitution, for your education.
Here's what the first amendment actually says:
Congress shall make no law respecting an establishment of religion,
or prohibiting the free exercise thereof; or abridging the freedom
of speech, or of the press; or the right of the people peaceably to
assemble, and to petition the government for a redress of grievances.
WARNINGS TO YOU IF YOU DO NOT COMPLY WITH OUR REQUEST:
We have been forced to contact the system administrator of your
server to inform them about the abuse being conducted over their server.
Here's the message we used in this case:
The email name you used is YOUREMAILNAME@YOURSERVER.com:
We contacted your server at YOURSERVER.com to notify them of your abuse
with the following message:
The above user has sent unwanted and prior notified to STOP e-mail to this
address. We request that you instruct this person to delete our e-mail
address from his or her junk-mail list immediately, and to never contact
us again for any reason.
Our private e-mail facilities are not an advertising medium. People who
use them as such abuse our resources and waste our time.
(We included your original unsolicited message
to the system administrator, including all its headers
to better track you down.)
Additionally, if for example you are a member of one of the following services:
We would provide a note to America On-Line, CompuServe, AT&T and other
ISPs who frequently find themselves referenced in bogus return addresses:
Parties who claim to be sending mail from these domains when they are in
fact not doing so are committing fraud. Spam e-mail typically references
telephone numbers, physical addresses or web pages which are not bogus.
We will provide this information to them if you used their domain for a
bogus return address, so that they can also be urged to find the party
responsible and prosecute you.
FINAL WARNING:
If this waste of our resources does not cease immediately, please be
advised that we may activate the imbeded
Revenge(tm) program
for your email.
FAQ:
Revenge(tm) would automatically sign your email up for almost 300 mailing
lists to provide a graphic illustration of what it's like to receive
unwanted junk e-mail if it was activated.
NOTE:
While you may take offense to this, you should understand that lawyers
are of the opinion that this threat does not constitute any manner of
criminal action against you and while this would be another matter our
lawyers to act upon, keep in mind, that it does not threaten anyone.
It threatens to cause an indeterminate number of list servers to send
a lot of unsolicited e-mail to the author of the offending spam -> you –.
Inasmuch as you are the author of the spam that caused this situation
in the first place and have clearly indicated by your actions that
you feel that our PRIOR REQUEST TO STOP e-mailing does not constitute
abuse, you can hardly object to our use of it to communicate our feelings
on the matter in repy.
It is therefore our sincere desire that you comply with our request at
this time so that we do not have to respond further to your solicitation
as we have shown above that we are prepared to do:
Remove this e-mail address from your junk mail list immediately
and do not contact us EVER again in the future.
Thank You In Advance for Your Cooperation in this matter.
Use of Removal Message:
This message is sent in compliance of the new email bill section 301. Under Bill
S.1618 TITLE III passed by the 105th U.S. Congress. This message cannot be
considered Spam as long as you include the way to be removed and the senders info
to be true and not falsified. Paragraph (a)(c) of S.1618 This implies that you
will actually comply with requests to be removed from your mailing list and NOT
continue further mailings to the complaintant.
